Terms and conditions
Effective date: 15 October 2026 · Last updated: 15 October 2026
These Terms and Conditions (“Terms”) govern your access to and use of AskMama, including its website, mobile application, AI companion, messaging features, reminders and related services (“Service”).
The Service is operated by FinCore Africa Technology Ltd, a company registered in Nigeria, with its registered address at [Business Address] (“Company”, “we”, “us” or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. Purpose of the Service
AskMama is an AI-powered companion designed to support parents, guardians and caregivers with general newborn-care information, parenting education, routine tracking, reminders and conversational support.
Depending on the features available, the Service may allow users to:
- Ask general questions about newborn care and parenting.
- Record information about a baby's feeding, sleep, routines, allergies or reported sensitivities.
- Receive general educational information and suggested questions to discuss with a qualified healthcare professional.
- Track care-related activities and receive reminders.
- Interact with an AI companion at any time, subject to service availability.
The Service is intended to complement responsible caregiving and professional healthcare, not replace either.
2. Eligibility and parental responsibility
You must be at least 18 years old, or the applicable age of legal adulthood in your jurisdiction, to create an account and use the Service as a parent, guardian or caregiver.
By using the Service, you confirm that:
- You are authorised to provide information about the child whose information you submit.
- You will obtain any consent or authorisation required by applicable law before submitting a child's personal information.
- You will use the Service in the child's best interests.
- You will not represent AI-generated information as a professional medical diagnosis or prescription.
The Service is not intended to be operated independently by newborns or young children.
3. Important medical disclaimer
THE SERVICE IS NOT A MEDICAL PROVIDER. THE AI COMPANION IS NOT A DOCTOR, PAEDIATRICIAN, NURSE, PHARMACIST OR EMERGENCY MEDICAL PROFESSIONAL.
The Service does not provide medical diagnosis, clinical assessment, treatment, prescriptions or emergency medical care.
Any information provided by the AI is for general educational and informational purposes only. It is not a substitute for advice from a qualified healthcare professional who can assess the child directly.
You must not use the Service as the sole basis for:
- Deciding whether a newborn or infant requires medical attention.
- Diagnosing or ruling out a medical condition.
- Determining whether a child has an allergy.
- Deciding whether a medication, dosage, supplement or treatment is appropriate.
- Changing or stopping a treatment recommended by a healthcare professional.
- Delaying or avoiding a hospital visit, medical consultation or emergency response.
Always seek professional medical advice when you have concerns about a baby's health.
4. Newborn and infant safety
Newborns and young infants can deteriorate quickly. If a baby has difficulty breathing, develops a fever, experiences a seizure, becomes unusually inactive, cannot feed properly or exhibits another concerning symptom, seek urgent medical assessment.
For a newborn, do not wait for an AI response if you suspect an emergency. Contact an appropriate healthcare professional or emergency service immediately.
The Service may provide safety information or direct you towards medical care when a concerning situation is described. However, unless a feature has been specifically designed, validated and expressly described otherwise, the Service does not provide continuous monitoring, guarantee detection of emergencies or guarantee that alerts will be delivered.
5. Allergies and health information
Users may be able to record reported allergies, suspected sensitivities, previous reactions and other health-related information.
This information is supplied by the user and is not independently verified merely because it is stored or referenced by the AI.
The Service does not perform allergy testing, confirm allergies, guarantee the completeness of a baby's medical history or certify that a food, medicine, product or substance is safe for a particular child.
Do not introduce a suspected allergen, administer medication or disregard a known allergy based solely on AI-generated information. Consult a qualified healthcare professional.
6. Artificial intelligence limitations
The Service uses artificial intelligence to generate responses. AI-generated responses may be inaccurate, incomplete, outdated, misleading or unsuitable for a particular child.
The AI may misunderstand a question, fail to recognise the seriousness of a symptom, omit relevant information or produce inconsistent answers.
The Service may not have access to the baby's complete medical history, examination results, laboratory results or other information necessary for a clinical decision.
You are responsible for seeking appropriate professional assistance and verifying important information with qualified professionals.
We may modify, restrict, suspend or disable AI features where reasonably necessary for safety, maintenance, legal compliance or security.
7. User responsibilities
You agree to:
- Provide accurate information to the best of your knowledge.
- Keep account credentials secure.
- Use the Service lawfully and responsibly.
- Seek qualified medical advice for health concerns.
- Avoid submitting information about another person without appropriate authority.
- Notify us of suspected security issues or serious product-safety concerns.
- Avoid using the Service to develop or distribute harmful, unlawful or misleading content.
You must not attempt to compromise the Service, interfere with its security, misuse another person's account or access data without authorisation.
8. Privacy and personal information
Your use of the Service is also governed by our Privacy Policy, which explains how we process personal information, including information relating to parents, caregivers and children.
Health information, allergy information and information about a newborn must be handled with particular care.
We will process personal information in accordance with applicable data-protection laws and the practices disclosed in our Privacy Policy.
You should not submit unnecessary identifying information or information belonging to another person unless you are authorised to do so.
9. Service availability
We aim to provide a reliable Service but do not guarantee uninterrupted availability, continuous AI access, error-free operation or uninterrupted delivery of notifications.
The Service may be temporarily unavailable because of maintenance, network interruptions, third-party provider failures, security incidents or other circumstances.
The Service must not be relied upon as the sole channel for urgent medical communication, emergency alerts or essential care reminders.
10. Third-party services
The Service may rely on third-party AI providers, hosting services, analytics tools, notification providers or other technology partners.
Their involvement may be subject to separate terms and privacy practices. Where applicable, we will disclose relevant third-party processing in our Privacy Policy.
We are not responsible for the independent operation of third-party services to the extent permitted by applicable law. This clause does not remove any responsibility that cannot legally be excluded.
11. Intellectual property
Unless otherwise stated, the Service, its branding, software, design, original content and associated intellectual property belong to the Company or its licensors.
You receive a limited, non-exclusive, non-transferable and revocable right to use the Service for its intended purpose, subject to these Terms.
You must not copy, reverse-engineer, commercially exploit or redistribute the Service except as permitted by law or with our written permission.
12. Suspension and termination
We may suspend or terminate access where reasonably necessary because of a breach of these Terms, suspected fraud, security concerns, unlawful use or legal requirements.
You may stop using the Service at any time and may request account deletion in accordance with our Privacy Policy.
Where access is suspended or terminated, we will handle associated personal information in accordance with applicable law and our disclosed retention and deletion practices.
13. Limitation of liability
To the extent permitted by applicable law, the Company will not be responsible for losses arising solely from circumstances outside its reasonable control or from a user's unreasonable reliance on AI-generated information as a substitute for professional medical care.
Nothing in these Terms excludes, restricts or modifies any liability, consumer right, duty of care, warranty or remedy that cannot lawfully be excluded, restricted or modified.
Nothing in these Terms is intended to exclude liability for fraud, wilful misconduct, or negligence where such exclusion is prohibited by applicable law.
The Service is not represented as a substitute for professional healthcare, and users should make decisions concerning a child's health with appropriate professional assistance.
14. Indemnity
To the extent permitted by applicable law, you may be responsible for losses reasonably arising from your unlawful misuse of the Service, deliberate infringement of third-party rights or material breach of these Terms.
Nothing in this clause requires you to indemnify the Company for losses caused by the Company's own unlawful conduct or any liability that cannot legally be transferred to you.
15. Changes to the Terms
We may update these Terms to reflect changes to the Service, applicable law, safety practices or business operations.
Where required by law, we will provide notice of material changes and obtain any necessary consent. Continued use of the Service after an effective change will be subject to applicable law and any consent requirements.
16. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, subject to mandatory consumer-protection and other applicable legal requirements.
Disputes will be addressed through the procedures available under applicable law. Nothing in this clause removes a user's right to approach a competent regulator, tribunal or court where legally available.
